August 7, 2024: HYDERABAD: Vaccine maker Bharat Biotech on Wednesday said the Supreme Court of India has dismissed a public interest litigation filed against its Rotavirus vaccine.

The Hyderabad-based vaccine firm said the apex court on Tuesday (Aug 6, 2024) dismissed the PIL filed by S Srinivasan seeking segregated data of Phase-III double blind clinical trial results of the Rotavirus vaccine manufactured by the company.

“SC considered the arguments on merits, and dismissed the writ petition (civil) no 289 of 2016 on the ground that this is a roving inquiry by the petitioner, and the petitioner failed to disclose the entire facts before the court,” Bharat Biotech said.

Furthermore, it was also stated that the Hon’ble Court has already decided this issue in Jacob Puliyel v Union of India, Writ Petition (Civil) No. 607 of 2021 and the Court cannot sit over the analysis of experts appointed by the Government of India in high level technical teams.

“The current writ petition with similar reliefs was earlier filed by Dr Jacob Puliyel in the Delhi High Court and the same was dismissed on the ground that the writ petition is misconceived and motivated with private interest,” it said.

Additionally, it was stated that no case is made out to show that disclosure of the segregated data is essential in public interest, it added.

SC had thereafter dismissed the appeal filed by Dr Jacob Puliyel on the grounds that Dr Puliyel, who was a member of the National Technical Advisory Group On Immunisation, cannot maintain a petition in public interest.
